Inf.net Terms of Use - Effective December, 21 2009

By using and/or visiting this web site (hereinafter collectively, including all content
and functionality available through the Inf.net domain name, the “Inf.net Web Site” or
“Web Site”), you signify your acceptance of this Terms of Use Agreement ("Agreement").
The Agreement sets forth the legally binding terms for your use of the services offered by
Inf.net (referred to collectively as “Services"). The term "User" refers to a "Visitor"
(when you simply browse the Web Site or chat with the existing Infs) or you are a "Member"
(when you are registered with Inf.net, or purchased credits, or have the Inf.net embedded
on another page, like a blog, Web Site, or social network profile page). Please read this
Agreement carefully and save it. If you do not agree with any of these terms or privacy
notice, please do not use the Inf.net Web Site.

Inf.net is a social networking service and instant chat robot creator, which allows you
to create unique intelligent virtual characters (referred to as “Infs”) and to
communicate with other people and Infs.

The Services offered include but not limited to the Inf.net Web Site, Infs and any other
features, content or applications offered from time to time by Inf.net in connection with
the Web Site. The Content of the Web Site (“Content”) includes all content created on
http://www.inf.net  and includes all responses created in creating Infs, links and any
other content created or fed to your Infs to train them, whether your Inf is viewed on the
Web Site or embedded into another web site.

Inf.net may modify this Agreement from time to time and such modification shall be
effective upon posting by Inf.net on the Web Site. You agree to be bound to any changes to
this Agreement when you use the Inf.net Services after any such modification is posted. It
is therefore important that you review this Agreement regularly to ensure you are fully
updated regarding any changes.

 1.Eligibility to use the Services. Use of and Membership in the Services is void where
prohibited. By using the  Services, you represent and warrant the following:
a)all registration information you submit is truthful and accurate;
b)you will maintain the accuracy of such information;
c)you are 13 years of age or older; and
d)your use of the Services does not violate any applicable law or regulation.
Your Inf may be deleted and your Membership may be terminated without warning, if we
believe that you are under 13 years of age.
 2.Non-commercial use of the Services by Members. The Services are for the personal use
of Members only and may not be used in connection with any commercial endeavours except
those that are specifically endorsed or approved by Inf.net. Illegal and/or unauthorized
use of the Inf.net Services is prohibited and any information containing this type of
misuse may be removed from the relevant Infs without notice and may result in termination
of Membership privileges.
 3.Termination of Use. This Agreement shall remain in full force and effect while the
Services are used. The User has the right to terminate the use of the Inf.net Services at
any time.
 4.Password Safety. When you sign up to become a Member, you will also be asked to choose
a password. You are entirely responsible for maintaining the confidentiality of your
password. You agree not to use the account, username or password of another Member at any
time or to disclose your password to any third party. Inf.net has no responsibility for
any misuse of the passwords and accounts registered on Inf.net. You are solely responsible
for any and all use of your account and your password.
 5.Service Fees. You acknowledge that Inf.net reserves the right to charge for certain
Services and to change its fees from time to time in its discretion and without notice. If
Inf.net terminates your Membership because you have breached the Agreement, you shall not
be entitled to the refund of any unused portion of any fees.
 6.Copyright. Inf.net owns and retains all proprietary rights on the Web Site and the
Service and any Content posted on the Web Site or related to the Web Site, and code, and
methods of creating chat robots and Inf images. Inf.net materials may not be reproduced,
copied, edited, published, transmitted or uploaded in any way without a prior written
permission from Inf.net. You may not post, distribute or reproduce in any way any
copyright material, trademarks or other intellectual property or proprietary information
without obtaining the prior written consent of the owner of such proprietary rights. The
User has the right to export and distribute Infs in the form of images or widgets as it is
offered in the section of the Web Site, to the external resources in accordance with the
rules and content of the relevant resources. Hereby you agree that your Infs may also be
exported and distributed on the external resources by other Users and/or Visitors of the
Web Site, unless in is stated otherwise in the “Inf’s Site” section on the Web Site.
 7.Content Copyright on Inf.net. By displaying or publishing ("posting") any Content on
or through the Services, you hereby grant to Inf.net a limited license to use, modify,
publicly perform, publicly display, reproduce and distribute such Content on and through
the Services, including external resources. The license you grant to Inf.net is
non-exclusive (meaning you are free to license your Content to anyone else in addition to
Inf.net), fully-paid and royalty-free (meaning that Inf.net is not required to pay you for
the use on the Services of the Content that you post), sublicensable (so that Inf.net is
able to use its affiliates and subcontractors such as Internet content delivery networks
to provide the Services), and worldwide (because the Internet and the Services are global
in reach).
You represent and warrant the following:
a)You own the Content posted by you on or through the Services or otherwise have the
right to grant the license set forth in this section, and
b)The posting of your Content on or through the Services does not violate any rights of
any person. You agree to pay for all royalties, fees and any other expenses owing any
person by reason of any Content posted by you to or through the Services.
The Content is protected by copyright, trademark, patent, trade secret and other laws,
and Inf.net owns and retains all rights in the Content and the Services. Inf.net hereby
grants you a limited, revocable, non-sublicensable license to reproduce and display the
Content (excluding any software code) solely for your personal use in connection with
viewing the Web Site and using the Services.
 8.Content Policy.
 8.1.Your Inf's personality may not include the following items: telephone numbers,
street addresses, last names and any photographs containing nudity or obscene, lewd,
excessively violent, harassing, sexually explicit, contradictory to the public policy of
any applicable jurisdiction or otherwise objectionable subject matter. Despite this
prohibition, information provided by other Members (for instance, in their responses to
chat) may contain inaccurate, inappropriate, offensive or sexually explicit material, or
otherwise objectionable products or services, and Inf.net assumes no responsibility or
liability for this material. If you become aware of misuse of the Services by any person,
please contact Inf.net by the means stated in the “Contacts” section. Having revealed
such abuse, Inf.net reserves the right to terminate the prohibited information and/or the
relevant Inf and/or the User's access to all or any part of the Services.
Inf.net may delete any Content in its sole judgement if it violates this Agreement or
which may be offensive, illegal or violate the rights, harm or threaten the safety of any
person or be contradictory to the public policy of any applicable jurisdiction or
otherwise objectionable. Inf.net assumes no responsibility for monitoring the Services for
inappropriate Content or conduct. If at any time Inf.net chooses, in its sole discretion,
to monitor the Services, Inf.net nonetheless assumes no responsibility for the Content, no
obligation to modify or remove any inappropriate Content, and no responsibility for the
conduct of the User submitting any such Content.
 8.2.You are solely responsible for the Content that you post on or through any of the
Services, and any material or information that you transmit to other Members and for your
interactions with other Users and Infs. Inf.net does not endorse and has no control over
the Content. Content is not necessarily reviewed by Inf.net prior to posting and does not
necessarily reflect the opinions or policies of Inf.net. Inf.net makes no warranties,
express or implied, as to the Content or to the accuracy and reliability of the Content or
any material or information that you transmit to other Members or Infs. Please choose
carefully the information you post on Inf.net and that you provide to other Users or Infs.
All the information posted on Inf.net maybe available to other Users.
Inf.net reserves the right, in its sole discretion, to reject, refuse to post or remove
any posting (including private messages) by you, or to restrict, suspend or terminate
access to all or any part of the Services at any time, for any or no reason, with or
without prior notice and without liability. Herewith you agree that in case of access
suspension you may not have access to your Inf (Infs) or any other information related to
your Inf (Infs).
 8.3.Inf.net provides its users with a possibility to create third level domain names. It
is your sole responsibility that it does not infringes any rights of third parties.
Inf.net reserves the right to terminate any third level domain name to use it for Inf.net
own purposes.
 9.Prohibited Content. Inf.net reserves the right to investigate and take appropriate
legal action against anyone who, in Inf.net's sole discretion, violates provision of any
kind of Content that is illegal or prohibited to post, including without limitation,
removing the offending communication from the Inf.net Services and terminating the
Membership of such violators.
 10.Prohibited Activities. Inf.net reserves the right to investigate and terminate your
membership if you have misused the Service, or behave in a way which we regard as
inappropriate, unlawful or illegal. We may suspend or terminate any member or hide the Inf
if it is judged offensive or if it includes identifying information.
 11.Member Interactions. You are solely responsible for your interactions with other
Members. Inf.net reserves the right, but has no obligation, to monitor disputes between
you and other Members.
 12.Privacy Policy. Use of the Inf.net Services is also governed by our Privacy Policy,
which is incorporated into this Agreement by this reference.
 13.Copyright Policy. You may not post, modify, distribute or reproduce in any way any
copyrighted material, trademarks or other proprietary information belonging to others
without obtaining the prior written consent of the owner of such proprietary rights. It is
the policy of Inf.net to terminate Membership privileges of any Member who repeatedly
infringes the copyright rights of others upon receipt of proper notification to Inf.net by
the copyright owner or the copyright owner's legal agent.
 14.Customer Service. Inf.net provides assistance and guidance through its customer
service representatives. If we feel that your behaviour towards any of our customer
service representatives or other employees is at any time threatening or offensive, we
reserve the right to immediately terminate your membership and you will not be entitled to
any refund.
 15.Other Disputes. This Agreement shall be governed by, and construed in accordance with
English law, without reference to its conflict of laws, and the parties hereby irrevocably
agree that any dispute, controversy or claim arising out of or in connection with this
Agreement, including any question regarding its existence, validity, interpretation,
breach or termination (a "Dispute"), shall be referred to and finally resolved by the
London Court of International Arbitration (“LCIA”) under the rules of the LCIA (the
"LCIA Rules") which rules are deemed to be incorporated by reference into this clause 15.
The tribunal shall consist of three arbitrators one of whom shall be nominated by Inf.net,
one by another party, and the third arbitrator, who shall act as chairman of the tribunal,
shall be nominated by the two arbitrators nominated by or on behalf of the parties. If he
is not so nominated within 30 days of the date of nomination of the later of the two
party-nominated arbitrators to be nominated, he shall be chosen by the President of the
LCIA. The arbitrators shall have the power, if so requested, and if they consider it
appropriate in their sole discretion, to determine any issue or Dispute on the basis of
written submissions and/or signed witness statements only. The seat of the arbitration
shall be London. The language of the arbitration shall be English. There shall be no right
of appeal on any question of fact or law. Neither party shall be required to give general
discovery of documents but may be required only to provide specific and identified
documents which are relevant to the Dispute. In the event either party shall bring any
action to enforce or protect any of its rights under this Agreement, the prevailing party
shall be entitled to recover, in addition to its damages, its reasonable attorneys' fees
and costs incurred in connection therewith.
 16.Indemnity. You agree to indemnify and hold Inf.net, its subsidiaries and affiliates,
and their respective officers, agents, partners and employees, harmless from any loss,
liability, claim, or demand, including reasonable attorneys' fees, made by any third party
due to or arising out of your use of the Inf.net Services in violation of this Agreement
and/or arising from a breach of this Agreement and/or any breach of your representations
and warranties set forth above and/or if any Content that you post on the Web Site or
through the Services causes Inf.net to be liable to another.
 17.Disclaimers. The material at the Web Site is provided 'as is' without any conditions,
warranties or other terms of any kind. Accordingly, to the maximum extent permitted by
law, Inf.net provides you with this Web Site on the basis that Inf.net excludes all
representations, warranties, conditions and other terms (including, without limitation,
the conditions implied by law of satisfactory quality, fitness for purpose and the use of
reasonable care and skill) which but for this legal notice might have effect in relation
to this Web Site. We do not represent or endorse the accuracy or reliability of any
advice, opinion, statement or other information displayed, uploaded or distributed through
the Service by us, our partners or any member or any other person or entity. You
acknowledge that any reliance upon such opinion, member profile, Inf, advice, statement or
information is at your own risk. We are not responsible for the conduct whether online or
offline of our members. Please use caution and common sense when using the Web Site and
the Service. THIS LEGAL NOTICE AND THE FOREGOING DISCLAIMERS ARE WITHOUT PREJUDICE TO ANY
MANDATORY LEGAL RIGHTS THAT CANNOT BE EXCLUDED UNDER APLICABLE LAW INCLUDING YOUR
STATUTORY RIGHTS AS A CONSUMER.
Inf.net is not responsible for any incorrect or inaccurate Content posted on the Web Site
or in connection with the Inf.net Services, whether caused by Users of the Services or by
any of the equipment or programming associated with or utilized in the Inf.net Services.
Infs created and posted by Members on the Web Site may contain links to other web sites.
Inf.net is not responsible for the Content, accuracy or opinions expressed on such web
sites, and such web sites are in no way investigated, monitored or checked for accuracy or
completeness by Inf.net. Inclusion of any linked web site on the Inf.net Services does not
imply approval or endorsement of the linked web site by Inf.net. When you access these
third-party web sites, you do so at your own risk. Inf.net takes no responsibility for
third party advertisements which are posted on this Web Site or through the Services, nor
does it take any responsibility for the goods or services provided by its advertisers.
Inf.net is not responsible for the conduct, whether online or offline, of any User of the
Services. Inf.net assumes no responsibility for any error, omission, interruption,
deletion, defect, delay in operation or transmission, communications line failure, theft
or destruction or unauthorized access to or alteration of, any User or Member
communication. Inf.net  is not responsible for any problems or technical malfunction of
any telephone network or lines, computer online systems, servers or providers, computer
equipment, software, failure of any email or account due to technical problems or traffic
congestion on the Internet or on any of the Inf.net Services or combination thereof,
including any injury or damage to Users or to any person's computer related to or
resulting from participation or downloading materials in connection with the Inf.net
Services. Under no circumstances shall Inf.net be responsible for any loss or damage,
including personal injury or death, resulting from use of the Services, attendance at a
Inf.net event, from any Content posted on or through the Inf.net Services, or from the
conduct of any Users of the Services, whether online or offline. The Inf.net Services are
provided "AS-IS" and as available and Inf.net expressly disclaims any warranty of fitness
for a particular purpose or non-infringement. Inf.net cannot guarantee and does not
promise any specific results from use of the Services.
 18.Limitation on Liability. IN NO EVENT SHALL INF.COM BE LIABLE TO YOU OR ANY THIRD
PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES,
INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF INF.COM HAS
BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY
CONTAINED HEREIN, INF.NET'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF
THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO
INF.NET FOR THE INF.NET SERVICES DURING THE TERM OF MEMBERSHIP.
Inf.net, and any related company, will not be liable or responsible to you or any third
person for any amount or kind of loss or damage that may result (including without
limitation, any direct, indirect, punitive or consequential loss or damages, or any loss
of income, profits, goodwill, data, contracts, use of money, or loss or damages arising
from or connected in any way to business interruption of any type, and whether in tort
(including without limitation negligence), contract or otherwise) in connection with the
Service, this Web Site or any Inf.net events developed, staged, managed or outsourced by
Inf.net in any way or in connection with the use, inability to use or the results of use
of this Web Site. Subject to the foregoing, Inf.net's liability to you for any cause
whatsoever, and regardless of the form of the action, will at all times be limited to the
amount paid, if any, by you to Inf.net for the Service during the term of membership.
Inf.net makes no representations that the Inf.net Website is appropriate or available for
use in other locations. Those who access or use the Inf.net Website from other
jurisdictions do so at their own volition and are responsible for compliance with local
law.
 19.Other. This Agreement is accepted upon your use of the Web Site or any of the
Services and is further affirmed by you becoming a Member. This Agreement constitutes the
entire agreement between you and Inf.net regarding the use of the Services. The failure of
Inf.net to exercise or enforce any right or provision of this Agreement shall not operate
as a waiver of such right or provision. The section titles in this Agreement are for
convenience only and have no legal or contractual effect. Inf.net is a trademark of
Inf.net company. This Agreement operates to the fullest extent permissible by law. If any
provision of this Agreement is unlawful, void or unenforceable, that provision is deemed
severable from this Agreement and does not affect the validity and enforceability of any
remaining provisions.
Inf.net may, and you may not, assign, convey, subcontract or delegate rights, duties or
obligations under this Agreement. You agree that no partnership, joint venture,
employment, or agency relationship exists between you and Inf.net as a result of this
agreement or use of this Web Site.
Inf.net reserves all rights to change, modify or delete any terms of this Agreement at
its sole discretion and without notice.
This Agreement, accepted upon use of the Web Site and further affirmed by becoming a
member of the Service, contains the entire agreement between you and Inf.net regarding the
use of the Web Site and/or the Service. If any provision of this Agreement is held
invalid, the remainder of this Agreement will continue in full force and effect.

Privacy Policy

This statement applies to Inf.net’s products, services and Web Sites worldwide
(collectively, “Services”).

Inf.net collects personal information when you register for the Inf.net Services or
otherwise voluntarily provide such information to the registered users (referred to as
“Users”) or the virtual characters (“Infs”). We may combine personal information
collected from you and your Inf or Infs with information from your profile pages in order
to improve Services provided.

Inf.net’s servers automatically record information when you visit the Inf.net Web Site
or chat with Infs from any other web site. The information may include the URL, IP
address, type of browser, language, the date and time of your requests.

Browsing the Inf.net Web Site (“Web Site”) you can chat with any Infs available one
the Web Site without having registered with Inf.net. You also can contact us through the
Inf.net Customer Service Centre or by emailing us directly without having to register for
an account.
For some activities on Inf.net, like creating and teaching Infs, you need to be
registered with Inf.net. We ask for some personal information when you create an account,
including your email address and a password, which is used to protect your account from
unauthorized access.
When you use Inf.net, we may record information about your Inf location on other web
sites, the conversation logs with the Users and any other activities regarded to your
Infs.
Any personal information that you voluntarily disclose online (e.g., conversations with
Infs, posts in the blog or the forum) may be collected and used by others.
If you submit personal information to Inf.net, we may use that information to operate,
maintain, and improve the features and functionality of Inf.net and to process any
activity or other information you send to us.
We do not use your email address or other personal information to send commercial or
marketing messages without your consent. We may use your email address without further
consent for non-marketing or administrative purposes (such as notifying you of major
Inf.net changes or for customer service purposes). You also can choose if you do not wish
to receive messages from Inf.net about certain events related to your Infs. This function
is available from you personal page on the Inf.net Web Site.

We may use cookies and log file information in order to:
    a)store information so that you will not have to re-enter it during your current or
the next visits of Inf.net;
    b)observe the effectiveness of our marketing campaigns;
    c)observe aggregate data such as number of visitors and pages viewed;
    d)track your entries and chats in promotions and contests;
    e)continue working on custom, personalized content.
